Official Contest Rules

THIS "Mosquito Slap Dance $1,000" CONTEST (the "Contest") IS A GAME OF SKILL CONTEST OFFERED BY QUANTUM, INC. ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE LOCATED IN THE U.S AND AT LEAST 13 YEARS OLD AT THE TIME OF CONTEST PARTICIPATION.



PARTICIPATION IN THIS CONTEST CONSTITUTES ENTRANT'S (AND IF UNDER 18 YEARS OLD OR NOT OF THE AGEOF MAJORITY IN STATE OF RESIDENCE, HIS OR HER PARENT OR LEGALGUARDIAN) FULL & UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL CONTEST RULES. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS OR YOU DO NOT MEET THE ELIGIBILITY CRITERIA SET FORTH IN THESE RULES, DO NOT PARTICIPATE IN THIS CONTEST.



NO PURCHASE NECESSARY. THIS CONTEST IS VOID WHERE PROHIBITED.



1. ELIGIBILITY: This Contest is sponsored by Quantum, Inc. ("Quantum"). The Contest is offered only in the United States to legal residents Washington D.C. and of the 50 United States who are located in the United States and at least 13 years old at the time of Contest participation. Employees and directors of Quantum, and each of their parents, affiliates and subsidiary companies, their advertising and promotional agencies and each of their immediate family members or members of the same households of such employees and directors are not eligible. Quantum may disqualify or exclude any Contest participant at anytime for any action taken in violation of these Official Contest Rules or any behavior deemed inappropriate or injurious to others. Disqualification may also result and an alternative Winner may be named, if for any reason a prize notification or prize is returned as non-deliverable or if Winner is found to be ineligible to receive the prize. The decisions of Quantum or its designee in this regard are final and binding upon all participants.



2. TO ENTER: Eligible participants need to comply with the following Submission Format and Content Requirements:

 

a) The Challenge:  Whether you’re waving your hands in the air, slapping ’em off, or swatting ’em down, create an original mosquito dance video (set to any style of music) using body percussion to slap the mosquitoes off.  You don’t need to purchase Buzz Away Extreme or even feature it in your video – unless you want to! Once you upload your video, it will automatically run with a special Buzz Away Extreme video tag at the very end. This tag can be viewed here. Entries must be between :30 seconds and 2 ½ minutes.



c) MANDATORIES (summary)

Submissions must be entrant’s original work

If you use a repellent in your video, only fantasy or imaginary mosquito repellents or contraptions may be featured (branded or homemade mosquito repellents are not allowed)

Length of video must be between a minimum of 30 seconds and a maximum of 2 ½ minutes.

Entries must be primarily in English and no larger than 1 GB.

Upload your submissions by July 4th, 2011, to be eligible

No cursing, explicit sex, illegal drugs, dangerous stunts or weapons.

Anyone, any age can enter. But if you’re under 18, you’ll fill out a special form

If friends appear in your video, they have to sign this talent release form

d) Judging Criteria:

· BEST VIDEO: $1,000 Grand Prize Entries will be judged on their creativity, originality and rhythmic excellence (60%); and production quality (40%). Our judges will pick the Top Ten for display on our web site and from those, the grand prize winner who will receive $1,000.

· MOST VIEWED: $250 Prize It’s all about raw numbers here. Whoever receives the greatest number of total views before the contest ends, wins!


e) To Submit a Video:

Visit the contest website (www.BuzzAwayVideo.com) and follow the on-screen instructions for the Contest



f) Technical Requirements:

Files cannot be larger than 1 GB.

Files must be in one of the following formats:

wmv, wma, wav, QT, mpg, mpeg, AVI, asf, mp3, mp4, MTS, qcelp, movieclip, MOD, m4a, flv, dv, amr-nb, 3gpp2, 3gpp,3gp2, 3gp.

Be sure to save your submission in the original format as well. If your submission is selected by Quantum, you will need to provide your submission in its original format. Additionally, you may be asked to provide the original audio and video files used during production of the entry for broadcast purposes.



g) Other Requirements:

    • Submission must be a minimum of thirty seconds (:30) or a maximum of two minutes and thirty seconds (2:30) in length and must be primarily in English.

   

•Once uploaded, Submission will not be returned and may not be modified or edited. Sponsor may, in its sole discretion, remove, delete and/or forfeit any submission it deems inappropriate or otherwise non-compliant.

   

•If any group of individuals elects to collaborate on a Submission, they are required to designate one (1) representative (Entrant) to enter the Contest and accept the prize on behalf of the group. Neither Sponsor nor any of the Contest Parties are liable for any disputes between collaborators related to a submission.



    • Each individual Entrant is allowed a total of ten (10) Submissions across all categories as long as the same (or substantially similar) Submission is not uploaded more than one (1) time throughout the Contest.



    • Each Submission must comply with these Official Rules.

   

•Each Submission must be the original work of the Entrant or group or any individuals of the group produced for this Contest; it may not have been entered in or won previous contests or awards (including previous Quantum contests); it may not have been published previously in any medium; it must not infringe any party's intellectual property or other rights; it must be suitable for display and publication on national television (i.e., it may not be obscene or indecent, including but not limited to nudity or profanity); it must not contain obscene or pornographic material or show harm to animals; any and all entrants or groups must disclose if they are members of the Screen Actors Guild (SAG) and, if determined to be a winner, must obtain applicable consents from such members of SAG; it must not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group); it must not include threats to any person, place, business, group or world peace; it must not invade privacy or other rights of any person, firm or entity; and it must not in any other way violate applicable laws and regulations or network standards.



· Get permission.
If you plan to shoot your video on someone’s private property, you’ll need written permission. Anyone who appears on camera and can be recognized in any manner will need to sign a Talent Release Form. If they’re under 18, their parents or legal guardians will also need to sign the form.     • Each Submission must not contain any copyrighted works (other than as owned by the Entrant, group or any individual member of the group). Submission may not contain or refer to any company/brand other use third party names, logos, or trademarks other than Quantum, Inc. and quantumhealth.com.

If you are a copyright owner or an agent thereof, and you believe that any content for this contest, which is hosted on the Fliqz Service, infringes your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C § 512(c)(3) for further detail): SEE BELOW, ADDENDUM A

    • Quantum reserves the right in its sole discretion to remove or blur or to ask the applicable Entrant to remove or blur any non-material elements (e.g. logos on clothing, vehicles, devices, images in the background, etc.) rather than disqualify an otherwise compliant Submission.



    • This contest is being hosted on by FLIQZ, therefore each Submission must comply with the FLIQZ Terms of Service (http://www.fliqz.com/aspx/terms.aspx)as well as these Official Rules. In the event of any inconsistency between these Official Rules and the FLIQZ Terms of Service the terms in these Official Rules shall prevail.



All Submissions will be reviewed for content before being published or judged; however, such review does not relieve entrant from responsibility for compliance with all of the Terms of Service and these Official Rules. Submissions that do not comply with the Terms of Services or these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be published or considered for prizes. Sponsor makes the final determination as to which Submissions are eligible to take part in this Contest and be considered for a Prize. Certain Submissions may be featured from time to time on the website during the Contest Period, in Sponsor's sole discretion; being selected as a featured Submission is unrelated to the Judging Criteria and does not guarantee selection as a Finalist in the Contest.



3. PARTICIPATION PERIOD/ TERM: Participation in this Contest begins on May 15, 2011 at 12:00:00 a.m. Pacific Standard Time (PST), and ends on July 5, 2011 at 11:59:59 p.m. PST. Any entries submitted after this time will be considered ineligible.



4. JUDGING: Based on Judging Criteria stated above, the best video and most viewed videos will be selected and deemed The Winners.



5. All ENTRIES WILL BE POSTED after screening for appropriate content starting when there are a sufficient number of videos entered. View counts for the‘most viewed’ video will begin to accrue as soon as it is posted on the site. The counting will end on July 9, 2011.



The 10 finalists and winner for the $1,000 prize will be selected and posted by the judges by July 15, 2011. The winning entrants will be promptly contacted and asked to sign or provide any releases, talent releases or affidavits that the Sponsor deems necessary. Such affidavits must be notarized where required by law. The winners will have 5 business days from receipt of these requests to return them to Quantum.



6. WINNERS: The Winners shall win the prizes specified herein. Only eligible participants may win prizes. If the Winners are not of the age of majority in their state(s) of residence, prizes may be awarded to the Winner’s parent or legal guardian at Quantum's sole discretion. Accepting and/or using prizes constitutes permission (except where prohibited by law) to use the Winners names, voices, hometowns and/or likenesses for promotional purposes without further compensation. Through acceptance and/or use of prize(s), Winners also agree to make up to two (2) revisions of winning entry at the request of Quantum for the purpose of broadcast approvals, at no charge.



Winners are responsible for all federal, state, and local taxes, including without limitation any applicable income taxes on prizes and for any other expenses relating to the use of prizes. Sponsor, to the extent required by law, reserves the right to notify local, state and federal taxing or regulatory authorities of the identity of the winner, the value of the prize, and any other information required by any applicable statute, regulation, or ordinance.



7. NOTIFICATION & OBTAINING WINNERS LIST: The Winners will be notified by July 15, 2011 on the contest website ("Site"). The winners will also be notified by email, phone and/or regular mail if possible (to the mailing address that was provided to Quantum). Failure to provide accurate contact information will result in the forfeiture of the prize. A complete list of the Winners will be posted on the Site and is also available to you by sending a self-addressed stamped envelope with your request to Quantum, Inc. at "Quantum, Inc,, PO box 2791, Eugene, OR 97402, Attention: Buzz Away Extreme Video Challenge with the title "Request for Winners List."



If a selected Winner cannot be contacted, is ineligible, fails to claim a prize within five (5) days of notification, or fails to comply with any term or condition of these Official Rules, prize may be forfeited and the next in line Winner will be selected. Quantum is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify Winners.



8. PRIZES:

Best Video: Buzz Away Extreme (:30 up to 2:30) $1,000



Most Viewed Video: Buzz Away Extreme (:30 up to 2:30) $250



Total value of all prizes = $1,250 (U.S.). No alternative prize, cash equivalent, or other substitution is permitted except by Quantum in the event of prize unavailability. Prizes are nontransferable. No assignment, transfer, or substitution of prize is permitted except by Quantum, for a prize of equal or greater value, in the event a prize is unavailable. All federal, state and/or local taxes are the sole responsibility of the Winners.



9. PUBLICATION, OWNERSHIP OF SUBMISSION AND PUBLICITY. All entrants agree to allow their video to be published by Quantum, in any medium, and at any time in perpetuity. Entrants agree to grant to Quantum all intellectual property rights to entrant's video. By accepting any prize, Winner grants to Quantum, Inc. and those acting with Quantum, Inc.'s permission, its parents, subsidiaries and related companies, the exclusive right but not the obligation to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web, at any time or times, the Winner's video submission as well as Winner's full name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration/compensation, and without notice, approval or review. Winner agrees that any further grant of permission to use the Winner's name, portrait, picture, voice, likeness and biographical information, as stated above, may be secured by Quantum electronically, for example by email, and such email secured permission will have the same force and effect as if that permission had been secured in a written document which was physically executed by the Winner.



10. LIMITATION OF LIABILITY. ALL PARTICIPANTS SHALL HOLD QUANTUM (FOR PURPOSES OF THIS SECTION ONLY, "QUANTUM" SHALL INCLUDE QUANTUM, INC. AND ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, REPRESENTATIVES, AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION AND FULFILLMENT AGENCIES, AND LEGAL ADVISORS) ENTIRELY AND FOREVER HARMLESS AND RELEASE AND INDEMNIFY QUANTUM FROM ANY DAMAGES, CLAIMS AND/OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPATION IN THIS CONTEST OR PARTICIPANT'S SUBMITTED MATERIALS. QUANTUM IS NOT RESPONSIBLE FOR INJURY OR DAMAGE TO PARTICIPANT'S OR 3RD PARTY INTELLECTUAL PROPERTY INFRINGMENT RESULTING FROM PARTICIPATING IN THIS CONTEST. QUANTUM RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CANCEL, TERMINATE, MODIFY OR OTHERWISE SUSPEND OR DISCONTINUE THIS CONTEST (I.E. THE CONTEST IS NOT CAPABLE OF RUNNING AS PLANNED, UNAUTHORIZED INTERVENTION, FRAUD, TECHNICAL FAILURES, OR FOR ANY OTHER CAUSES WHICH QUANTUM IN ITS SOLE OPINION, DEEMS COULD CORRUPT OR AFFECT THE ADMINISTRATION, SECURITY, FAIRNESS, INTEGRITY OR PROPER CONDUCT OF THIS CONTEST). IN THAT EVENT, QUANTUM MAY OR MAY NOT CHOOSE TO SELECT A WINNER, BUT IF SO, IN SUCH A MANNER AS QUANTUM MAY DEEM FAIR AND APPROPRIATE.

IN SUCH JURISDICTIONS, LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW. 11. DISPUTES: As a condition of participating in this Promotion, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the city of Eugene in Lane County having competent jurisdiction, which Court shall apply the laws of the State of Oregon without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased. All applicable federal, state, provincial and local laws and regulations apply.



These rules can be changed at any time by Quantum for clarification purposes during the term of the Contest.

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Fliqz to locate the material;
